Effective Date: October 25, 2026
Welcome to Opsi Digital Solutions. These Terms & Conditions (“Terms”) govern your access to our website, the purchase of our digital services, website development projects, and ongoing maintenance subscriptions.
By purchasing our services or subscribing to a maintenance plan, you agree to these Terms and any applicable service-specific conditions presented before checkout.
1. About Our Services
Opsi Digital Solutions is a digital services business operating in Georgia, United States.
Our services may include:
- Business website design and development.
- E-commerce website development.
- Appointment and booking website solutions.
- Landing page development.
- Website maintenance and technical support.
- Website hosting and domain-related services.
- Digital advertising materials and creative services.
- Additional digital solutions offered through our website.
Service features, pricing, and deliverables are determined by the product description and any written agreement confirmed before purchase.
2. Payments and Orders
Website development projects require 100% payment in advance unless a different payment arrangement is expressly agreed to in writing.
All prices are displayed in U.S. dollars (USD). Payments are processed through the payment methods available at checkout.
An order confirmation acknowledges receipt of payment but does not automatically establish the project’s official development start date.
Work begins only after the customer has submitted the required project information and Opsi Digital Solutions has confirmed the official start date in writing.
Additional work outside the purchased package may require a separate quotation and payment.
3. Project Starter Kit and Customer Responsibilities
Following a qualifying website development purchase, the customer will receive access to a downloadable Project Starter Kit.
The kit explains the development process and identifies the information, materials, and instructions required to begin.
The customer must submit the requested information within 7 calendar days after purchase.
Required materials may include business information, website text, logos, images, branding preferences, contact details, and requested functionality.
Materials may be submitted through the official communication channels provided by Opsi Digital Solutions.
Customers are responsible for ensuring that submitted materials are accurate, authorized for use, and do not infringe third-party intellectual property rights.
If required materials are incomplete or submitted late, the project start date and delivery schedule may be postponed. Opsi Digital Solutions will communicate any resulting changes in writing.
4. Website Development Timeline
The project timeline begins only after Opsi Digital Solutions confirms the official start date in writing.
- Initial Review: Within 7 calendar days after the confirmed project start date.
- Customer Feedback: Within 3 calendar days after receiving the initial review, the customer must provide consolidated feedback.
- Final Delivery: The standard target is within 21 calendar days after the confirmed project start date.
These deadlines apply to the agreed scope and depend on timely cooperation, access, approvals, and material submissions.
Any changes to the delivery schedule must be communicated and agreed upon in writing.
Customer silence will not automatically constitute acceptance or final approval.
Delays caused by missing materials, additional requests, third-party providers, or circumstances outside reasonable control may require a mutually agreed schedule adjustment.
5. Revisions and Additional Requests
Revisions are limited to the scope and features included in the purchased package or a separate written agreement.
Customers must provide clear and consolidated feedback during the designated review period.
Requests involving additional pages, major redesigns, new features, new integrations, or functionality not included in the original agreement may be treated as additional services.
Such work may require a separate quotation and customer approval before implementation.
6. Domain Registration and Renewal
Eligible website development packages include the first year of one standard domain registration, subject to availability and the conditions stated in the purchased package.
Premium domains, specialized extensions, and other registration expenses may incur additional charges.
After the included first year, the customer is responsible for domain renewal costs at the applicable market rate.
Opsi Digital Solutions does not guarantee the availability of a particular domain name.
Domain ownership and registration arrangements will be determined by the applicable registration information and service agreement.
7. Website Hosting and Maintenance
Website hosting is included while the customer maintains an eligible, active website maintenance membership with Opsi Digital Solutions.
Hosting services and technical benefits depend on the applicable subscription plan.
Active memberships may include website updates, backups, security monitoring, functionality checks, technical support, and other plan-specific benefits.
The exact features and limitations of each membership are described on the relevant subscription product page.
Opsi Digital Solutions does not guarantee uninterrupted or error-free operation.
8. Membership Subscriptions and Renewals
Opsi Digital Solutions offers recurring monthly website maintenance plans:
- Basic Care: $39 per month.
- Business Care: $79 per month.
- Premium Care: $149 per month.
Each plan provides the services and benefits specified in its current product description.
Where automatic renewal is enabled and expressly authorized by the customer, subscriptions renew monthly until canceled.
Recurring charges, billing frequency, renewal terms, and cancellation instructions must be clearly disclosed before enrollment.
Customers may cancel future subscription renewals through the cancellation method provided on our website or by contacting customer support.
Cancellation prevents subsequent recurring billing, subject to payment processing timing and applicable law.
Cancellation does not automatically create a refund for services already provided, unless required by law or the applicable Refund & Cancellation Policy.
9. Website Ownership After Membership Cancellation
Canceling a maintenance membership does not automatically transfer ownership of a customer’s website to Opsi Digital Solutions.
Customers may continue operating their completed website without an active maintenance membership.
Continued use of Opsi-managed hosting requires payment of applicable standalone annual hosting fees and domain renewal costs.
After cancellation, the customer will no longer receive membership benefits, including maintenance, included technical support, and subscription-specific services.
Access to Opsi-managed administrative accounts or infrastructure may be restricted when the customer no longer subscribes to applicable managed services.
This restriction does not remove ownership rights the customer otherwise holds in its website content or delivered materials.
Website exports, hosting migration, or additional technical assistance may involve separately disclosed fees.
Opsi Digital Solutions will cooperate with reasonable transition requests in accordance with applicable law, third-party licensing requirements, and contractual rights.
10. Advertising and Creative Services
Certain memberships may include promotional graphics, advertising copy, or other creative materials.
When included, these services are provided upon customer request during the applicable service period.
Unused creative service allowances do not accumulate or roll over into future billing periods unless expressly stated otherwise.
Advertising campaign management, platform charges, and paid advertising budgets are not included unless specifically agreed upon in writing.
Opsi Digital Solutions does not guarantee advertising performance, sales, conversions, or specific financial results.
11. Intellectual Property and Customer Materials
Customers retain ownership rights in original logos, business information, photographs, trademarks, and other materials they provide.
The customer grants Opsi Digital Solutions permission to use submitted materials as reasonably necessary to perform contracted services.
Upon full payment and final delivery, ownership or usage rights in the completed website deliverables will be determined by the applicable package description and any written project agreement.
Third-party themes, plugins, fonts, stock assets, software, and licensed components remain subject to their respective license terms.
Opsi Digital Solutions retains ownership of its pre-existing tools, proprietary methods, templates, and other materials not expressly transferred to the customer.
12. Third-Party Platforms and Integrations
Our services may depend on third-party providers, including hosting companies, payment processors, domain registrars, WordPress plugins, scheduling platforms, and external software services.
These providers may establish independent terms, fees, licensing requirements, and usage restrictions.
Opsi Digital Solutions is not responsible for third-party service changes, outages, or discontinued features beyond its reasonable control.
We will communicate material issues affecting active contracted services when appropriate.
13. Refunds and Project Cancellations
Refunds, cancellations, and any applicable deductions are governed by our separate Refund & Cancellation Policy, which forms part of these Terms where incorporated into the purchase agreement.
Once website development has officially commenced, payments are non-refundable for voluntary customer cancellations or changes of mind, except where required by law or expressly agreed in writing.
Before project commencement, cancellation and refund requests will be handled under the Refund & Cancellation Policy, including any applicable, previously disclosed nonrecoverable expenses.
No provision eliminates any nonwaivable rights available to customers under applicable law.
14. Customer Accounts and Security
Customers are responsible for maintaining the confidentiality of their login credentials.
Customers must provide accurate account information and notify Opsi Digital Solutions of any suspected unauthorized access.
Access to certain account features may depend on the services purchased or an active subscription.
Unauthorized access, fraudulent transactions, or misuse of our services may result in appropriate account restrictions, subject to applicable law.
15. Service Performance and Limitations
Opsi Digital Solutions will perform contracted services with reasonable care and professional diligence.
Website performance, search engine rankings, visitor traffic, customer inquiries, online sales, and business growth depend on factors beyond our control.
We do not guarantee specific search rankings, revenue, traffic levels, or business results.
To the extent permitted by applicable law, Opsi Digital Solutions will not be liable for indirect or consequential losses arising from matters outside its reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded.
16. Changes to These Terms
Opsi Digital Solutions may update these Terms to reflect changes in business operations, service offerings, or legal requirements.
Updated Terms will be published on our website with a revised effective date.
Material changes affecting existing subscriptions or active agreements will be communicated where required by applicable law.
Changes will not retroactively alter an existing contracted project without the agreement of the parties where legally required.
17. Governing Law
These Terms are governed by the applicable laws of the State of Georgia, United States, subject to any mandatory consumer protections or other laws that may apply.
Any dispute shall be handled according to applicable law and any valid dispute-resolution agreement separately accepted by the parties.
